Notario Publico (Notary Public)
The Notary Public, one of the most prestigious professions in Mexico, is appointed directly by the State Governor. The Notary Public, commonly referred to as Notario, has the power to witness and certify important business documents which require absolute authenticity. The appointment also holds responsibility for the management and secure storage of all original records. Notarios must be Mexican citizens of at least 35 years of age, hold a degree in Law, have three years work experience at a Notary Public office, and must pass a stringent State examination. Those who successfully pass the exam, in time, may be appointed as a Notary Public by the State Governor.
Under Mexican law, the Escritura (Property Deed) must be prepared by a Notario, who will then ensure that all documentation and permits are in order. A Notario has the authority to close a loan and transfer title upon obtaining a "Freedom of Liens," establishing collateral, and ensuring that transfer taxes and capital gain taxes are paid. The Notario will also register title with the Public Registry.

All real estate closings will be conducted at an authorized Notary Public.
